Agreement to Terms
These Terms of Service (“Terms”) govern your use of the Mantic Construction website at this domain and any services provided by Mantic Construction (“we,” “us,” or “our”), a residential construction company based in Cottage Grove, Minnesota.
By accessing this website, requesting an estimate, or entering into a project agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use this website or our services.
Our Services
Mantic Construction provides residential construction and remodeling services to homeowners within approximately 40 miles of Cottage Grove, Minnesota. Our services include, but are not limited to:
- Interior remodeling (basements, kitchens, bathrooms, living rooms, and other areas)
- Deck construction and outdoor living spaces
- Home additions and room expansions
- Custom home building (offered on a selective, project-by-project basis)
All services are subject to the execution of a written project agreement prior to commencement of any work. Nothing on this website constitutes a binding contract or guarantee of service availability. We reserve the right to decline any project at our discretion.
Estimates & Proposals
We offer free, no-obligation estimates to prospective clients. An estimate reflects our assessment of project scope and pricing at the time it is prepared and is subject to change based on updated project information, material costs, or site conditions.
Unless otherwise stated in writing, estimates are valid for 30 days from the date of issue. An estimate does not constitute a binding contract. Final pricing is established only upon execution of a written project agreement signed by both parties.
We strive to be transparent and accurate in our estimates. If unforeseen conditions arise during a project that materially affect cost, we will notify you promptly and discuss options before proceeding.
Project Agreements & Payment
No work will begin until both parties have signed a written project agreement detailing the scope of work, materials, project timeline, and payment schedule. The project agreement constitutes the binding contract between you and Mantic Construction and supersedes any prior verbal representations or estimates.
Payment terms, including deposit amounts, milestone payments, and final payment, are specified in each project agreement. Failure to make payments according to the agreed schedule may result in a suspension of work. Any unpaid balance outstanding beyond the agreed terms may be subject to applicable remedies under Minnesota law.
Scope Changes
Any addition to, deletion from, or modification of the agreed project scope must be documented in a written change order signed by the client before the change is executed. Verbal authorizations for scope changes will not be honored.
Change orders may affect project pricing and timeline. We will provide updated cost and schedule information for your approval before proceeding with any scope change. Work on the changed scope will not begin until the change order is signed and any required additional deposit is received.
Client Responsibilities
To allow us to complete your project efficiently and to the highest standard, you agree to:
- Provide safe, reasonable access to the property and work area on agreed project days
- Remove or secure personal property, furniture, and valuables from the work area prior to work beginning
- Make timely selections on materials, finishes, fixtures, and colors when requested so as not to delay the project
- Ensure that required utilities (electricity, water) are active and available at the property
- Notify us promptly of any concerns or changes to your project requirements
- Ensure that any required HOA approvals or neighbor notifications are in place before work begins
Delays caused by failure to fulfill these responsibilities may affect the project timeline and may be subject to additional charges as outlined in your project agreement.
Permits & Inspections
Where building permits are required by local authorities for your project, Mantic Construction will manage the application process. Permit fees are the responsibility of the client and will be included in the project agreement or billed as a pass-through cost, unless otherwise agreed in writing.
We conduct all work in compliance with applicable local, state, and federal building codes and regulations. Required inspections will be scheduled in coordination with the project timeline. We cannot guarantee inspection scheduling timelines set by government agencies, and project timelines may be affected by inspection delays outside our control.
Workmanship Warranty
Mantic Construction warrants all labor and workmanship performed under a project agreement for a period of one (1) year from the date of project completion, unless a longer period is expressly stated in your project agreement.
This warranty covers defects in workmanship arising under normal use and conditions. It does not cover:
- Damage caused by misuse, neglect, accidents, or acts of nature
- Modifications or repairs made by third parties after project completion
- Normal wear and tear or deterioration over time
- Issues arising from pre-existing conditions not documented in the project agreement
Materials and products supplied by third-party manufacturers are subject to those manufacturers’ own warranties. We will assist in facilitating manufacturer warranty claims where possible.
To make a warranty claim, contact us in writing at the contact information below within the warranty period. We will assess the claim and respond within a reasonable timeframe.
Photography & Portfolio Use
We take pride in our work and may photograph completed projects for use in our portfolio, website, and marketing materials including social media. Photos will not include identifying information about clients without explicit consent.
If you prefer that your project not be photographed or featured in our marketing, please notify us in writing prior to project completion. We will honor all such requests.
Intellectual Property
All content on this website — including text, graphics, images, logos, and design elements — is the property of Mantic Construction or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or use any content from this website for commercial purposes without our prior written consent. Limited personal, non-commercial use for the purpose of evaluating our services is permitted.
Limitation of Liability
To the fullest extent permitted by applicable law, Mantic Construction’s total liability for any claim arising out of or related to our services or this website is limited to the amount paid by you for the specific service or project giving rise to the claim.
We shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, loss of use, or property damage not directly caused by our workmanship, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability for damages arising from gross negligence or intentional misconduct, or for any liability that cannot be excluded or limited under Minnesota law.
Governing Law
These Terms and any dispute arising from your use of this website or our services are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any legal action not resolved through the process described in Section 13 shall be brought exclusively in the courts of Washington County, Minnesota, and you consent to personal jurisdiction in those courts.
Dispute Resolution
We believe most disputes can be resolved through honest, direct conversation. If you have a concern about our services or a project, we ask that you contact us first and give us a reasonable opportunity to address it before pursuing other remedies.
If we are unable to resolve a dispute informally within 30 days of written notice from either party, either party may pursue available legal remedies as permitted under Minnesota law. Nothing in this section limits your right to seek emergency or injunctive relief from a court of competent jurisdiction where necessary.
Updates to These Terms
We may revise these Terms from time to time as our services, practices, or legal requirements change. When we make material updates, we will revise the effective date at the top of this page. Your continued use of our website or services after an update constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically. If you disagree with a material change, your remedy is to discontinue use of our website and services.
